FOUR STAGES: (any party may withdraw at any time).

  1. Consultation

    (No Charge)

A consultation consists of an initial conversation of up to 1/2 hour for the purposes of determining whether meditation is the right tool for resolving a particular dispute, whether the parties are the right parties, whether the mediator is the right mediator and what other options might be considered. The cost of mediation, if it goes forward will be discussed.

There is no charge for an initial consultation.

2. Pre-Mediation

Separate meetings will be held with each party to advise of the process and the respective roles of the mediator and the parties to the mediation. Each party’s situation, point of view and history leading to the mediation will be reviewed and realistic general expectations will be described. If the parties agree to proceed, a date for mediation will be set and an “Agreement to Mediate” which sets out the terms of the mediation including its cost (to be shared by the parties) will be explained, and prepared by the mediator for signature by all parties.

3. Mediation

A mediation session will be a minimum of 3 hours long and will last as long as the parties decide and take as many sessions as they wish. It will begin with introductory remarks from the mediator to lay the groundworks. Each party will have an opportunity to make its remarks and tell its story. The mediator will facilitate a constructive discussion. If the mediation leads to possible solutions a negotiation may take place assisted by the mediator and, if agreeable to the parties a settlement will be achieved.

The emphasis is on the parties themselves arriving at a mutually satisfactory resolution. The mediator will not decide, adjudicate or impose an outcome.

4. Post-Mediation

After the mediation has concluded the mediator will issue a report to the parties and, if a resolution has been arrived at and the parties so request, the mediator will draft a simple memorandum of agreement for them.
